    Legal Shield Against Medicaid and Probate
    If you have personal assets and real estate equity by the time you hit your late '50s, over $200k, it's not a bad idea to explore this legal shield against Medicaid and probate. Court probate is expensive; dealing with long-term medical situations will entitle the government to drain everything you have otherwise. The main defense these guys do is set up a living trust that acts as a separate legal entity that can't be touched by the government when a family member goes into long-term nursing homes or hospice. I've heard some people argue that they just give it away to their kids before the government can take it. You just have to make sure you time it right; you have to do that at least 5 years in advance because Medicaid has a 5-year look-back period inside which they charge the kids to reclaim it to pay for your medical bills. For people who are in debt, it doesn't matter because there's nothing for the government to take so they just provided for free. For people that are really, really rich, it doesn't matter because they can just pay for whatever senior living they want. It's that middle class in between that gets hosed.
