Elder Law Services for Indiana Families
A sound plan should reflect the person’s health, family relationships, assets, and care needs. Elder law planning often addresses several connected issues rather than a single document.
Common areas of elder law planning include:
- Medicaid Planning: Medicaid planning uses legal strategies to arrange assets and income around eligibility rules for long-term care coverage. The right approach depends on the person’s finances, marital status, health, and anticipated care needs.
- Long-Term Care Planning: Planning can address how care will be provided and paid for, including the potential impact of nursing home costs on savings and property.
- Powers of Attorney: A financial power of attorney authorizes a trusted person to handle specified financial decisions if the individual can’t act independently. Because Indiana law requires a separate document for medical decision-making authority, families typically also put a health care advance directive in place.
- Guardianship: Guardianship is a court process for appointing someone to make decisions for a person who can no longer make them independently. It may become necessary when incapacity arises and no effective power of attorney is in place.
